Victory in constitutional court by opposition National Unity Platform (NUP) Member of Parliament, Francis Zaake clearly affirms that Uganda has rule of law and the courts are independent, says Deputy Presidential Press Secretary, Faruk Kirunda.
Kirunda in a tweet Wednesday evening challenged Zaake not only celebrate his victory but to also withdraw his earlier allegations of lack of justice in Uganda.
“Following Hon Zaake Francis’s victory in the Constitutional Court, I wish to ask; is the Court in Europe, Ghana, India of Uganda? How come the ruling went in his favour yet he is in opposition and always claims there is no justice in Uganda,” tweeted Kirunda.
The Constitutional Court in Kampala Thursday September 28, 2023 overturned Speaker Anita Among’s decision to remove Francis Zaake, the Member of Parliament for Mityana Municipality, from his position as a commissioner of Parliament.
In the ruling, court found out that the Speaker had violated the principles of natural justice and had not met the required quorum in Parliament at the time the decision was made, among other issues.
Francis Zaake, who is a member of the Opposition National Unity Platform (NUP), was removed from his position on March 10, 2022, following allegations of insulting Speaker Anita Among on social media. The removal was supported by 155 legislators.
Zaake filed a petition in the Constitutional Court, arguing that Parliament had passed the resolution to remove him without the necessary quorum, which he claimed violated several constitutional articles and parliamentary rules.
Additionally, he alleged that each member of the Parliament’s Committee on Rules, Privileges, and Discipline who participated in his removal had received a payment of 6 million shillings to support his removal.
