KAMPALA — The High Court has nullified the election of Luyimbazi Elias Nalukoola as the Member of Parliament for Kawempe Division North, citing irregularities that contravened provisions of the Parliamentary Elections Act.
In a ruling delivered on Monday, May 26, 2025, Justice Bernard Namanya set aside Nalukoola’s election and ordered the Electoral Commission to conduct a fresh poll for the constituency.
“That the election of Luyimbazi Elias Nalukoola as a Directly Elected Member of Parliament for Kawempe Division North constituency in Kampala District is set aside,” the ruling stated in part.
The court further declared the seat vacant and instructed the Electoral Commission to organize a new election to fill the position. Each party was directed to bear its own legal costs.
The decision was made in accordance with Sections 80, 82(4)(c), and 82(6)(c) of the Parliamentary Elections Act (Cap. 177), which provide for the nullification of an election where non-compliance with electoral laws is proven to have affected the outcome in a substantial manner.
The ruling is likely to trigger renewed political activity in the constituency as potential candidates prepare for a fresh electoral contest. The Electoral Commission is yet to announce the date for the by-election.
